Privacy Policy for Businesses

This Privacy Policy describes how Wisemove AI Solutions Pvt. Ltd. ("Wisemove", "we", "us" or "our") collects, uses, discloses, retains and protects personal data relating to Vendors in connection with the AasPaas business account and the publication of Listings on aaspaas.co (the "Platform").
Wisemove is the Data Fiduciary in respect of that personal data for the purposes of the Digital Personal Data Protection Act, 2023 ("DPDP Act"). This Policy is incorporated into and forms part of the Terms for Businesses.
A substantial proportion of Vendors on the Platform are individuals trading on their own account. Accordingly, information concerning a Vendor's business is treated in this Policy as that individual's personal data, and no business-to-business exemption is relied upon.
Clause 1 states which categories of information are published publicly. It is the provision most likely to affect you and is placed first for that reason.
1. Information Published Publicly
1.1Your Listing is a publicly accessible web page. It is intended to be discovered, shared and indexed by search engines. All Vendor Content appearing on it — including your business name, description, categories, service areas, opening hours, address where supplied, rate card, prices, offers, photographs and albums — is visible to any person.
1.2Two categories of information are deliberately excluded from publication. Your contact number does not appear in the Listing, in its source, or in its structured data; a Customer is handed to your number by way of a messaging link, with the consequence that the number cannot be extracted from the page by automated means. Information concerning your Subscription, your billing and the performance figures reported to you is never published.
1.3You should not submit within any free-text field information which you would not wish to be public. Such fields are screened for telephone numbers and email addresses, but that screening is a safeguard and not a warranty.
2. Personal Data We Collect
2.1Mobile number, collected in order to create and authenticate your business account, verified by a one-time code transmitted over WhatsApp.
2.2The contact number published on your Listing, which may differ from that in clause 2.1, and to which Customers using the contact facility are directed.
2.3Vendor Content, as defined in the Terms for Businesses, which you compose and publish yourself.
2.4Photographs submitted by you, which are held in private storage and are copied to publicly accessible storage only upon approval by a person.
2.5Where your category requires verification of identity, a verification record comprising the method used, the class of document examined and the last four digits of its number. The document itself, any image or copy of it, and any Aadhaar number are not stored at any time or in any system.
2.6Records of activity in relation to your Listing, comprising aggregate daily counts of openings of the Listing and of offers on it, and a record of each Customer who used the contact facility.
2.7Subscription status and, upon commencement of charging, such payment and invoicing records as are required for billing and taxation.
2.8Technical data, including internet protocol address and browser and device type, processed for the purposes of security and the application of rate limits.
3. Information Reported to You About Customers
3.1Where a Customer uses the contact facility, we report to you the date of the request, the last four digits of that Customer's mobile number and the Customer's first name where provided. The last four digits are reported rather than the full number so that the record may be reconciled by you against your own device; the number itself becomes known to you, if at all, through the Customer's own communication.
3.2We do not report the identity of any person who has merely viewed your Listing or an offer on it. Such activity is reported as an aggregate count only. A person who has viewed a page has not thereby consented to being contacted by you.
3.3Your obligations in respect of Customer personal data are set out in clause 9 of the Terms for Businesses.
4. Disclosure of Your Personal Data
We disclose your personal data only to the following categories of recipient, and only to the extent necessary:
4.1We do not sell, rent, trade or licence your personal data, and we do not disclose it to other Vendors, to lead-generation services, or to any person for the purpose of marketing to you.
- the public, in respect of all Vendor Content published on your Listing, that being its purpose;
- a Customer who uses the contact facility, who is directed to the contact number published on your Listing;
- WhatsApp (Meta Platforms), which transmits one-time codes and notifications to you and accordingly processes your mobile number for that purpose;
- our hosting, database and image-storage providers, which process personal data on our instructions as Data Processors for the purpose of operating the Platform;
- upon commencement of charging, a payment service provider, for the purpose of collecting Subscription amounts;
- any court, regulator, law-enforcement or other authority to which disclosure is required by law, and any person to whom disclosure is necessary for the establishment, exercise or defence of legal claims.
5. Records Maintained for the Protection of Users
Two categories of record are maintained which may not be apparent from the Platform, and both are stated expressly.
5.1A history of amendments to the prices published on your Listing is retained. It enables a genuine discount to be distinguished from a price presented as a regular price at which the Vendor has not in fact supplied, and it accordingly protects Vendors who price honestly.
5.2Records of complaints received concerning your Listing, and of enquiries to which no response was made, are retained. Such records are never published; a publicly displayed count of non-performance would constitute an unadjudicated allegation concerning an individual's livelihood. They may, however, affect the position of your Listing and may occasion an internal review.
5.3You are entitled to be informed of the contents of any record maintained under clause 5.2 concerning you and to submit a response to it, which shall be recorded alongside it.
6. Retention
6.1Business account and Listing data are retained for so long as the Listing subsists, and thereafter only to the extent necessary: billing and taxation records for the period prescribed by law, and, in respect of a Listing removed for fraud, such record as is necessary to prevent its recreation.
6.2A declined photograph is deleted from storage. The record of the decision and its stated reason is retained so that it remains visible to you.
6.3Aggregate counts are retained indefinitely, comprising numerical totals and not records relating to identifiable individuals.
7. Your Rights
7.1Under the DPDP Act you have the right to obtain a summary of the personal data we hold concerning you and of our processing activities; to seek its correction, completion or updating; to seek its erasure; to withdraw a consent previously given; and to nominate another person to exercise those rights in the event of your death or incapacity.
7.2Many of those rights may be exercised directly and immediately through the Platform. Your business pages permit every published particular to be amended, a photograph to be deleted, a price to be withdrawn from display, and all active sessions to be terminated. A request that your Listing be unpublished may be made at any time, upon which the page ceases to be publicly accessible.
7.3One limitation follows from the nature of the service rather than from any reluctance on our part: for so long as your Listing is published, the Vendor Content on it is public by design, and a request for the erasure of that content is necessarily a request that the Listing be unpublished.
7.4All other requests should be addressed to the Grievance Officer at support@aaspaas.co. We shall respond within the period prescribed by applicable law. If you are dissatisfied with our handling of a request, you may make a complaint to the Data Protection Board of India.
8. Security
8.1We employ reasonable security safeguards appropriate to the nature of the personal data processed, including encryption in transit, access controls over our systems, authentication by one-time code rather than by stored password, and the retention of submitted photographs in private storage until approved by a person.
8.2No system of electronic storage or transmission is entirely secure, and we make no representation that ours is. In the event of a personal data breach affecting you, we shall give notice to you and to the Data Protection Board of India as required by the DPDP Act.
9. Amendment of this Policy
9.1We may amend this Policy from time to time. The date stated at the head of this page identifies the version in force. Where an amendment requires your consent, we shall seek it rather than assume it.
